What Is Flat Fee MLS
Flat Fee MLS generally refers to the practice in the real estate industry of a seller entering into a "limited service agreement" with a real estate agent who lists the property for sale in the local Multiple Listing Service (MLS) for a set dollar amount (the "Flat Fee"). Two important disctinctions between a "flat fee" listing and "full service" listing should be noted: first, the flat fee agent is usually acting in a limited capacity on behalf of the seller; and second, compensation is generally paid "up front" to the agent for the contracted services, as opposed to a commission paid at closing based on the sales price of the property. The purpose of flat fee MLS is to reduce the overall cost of selling real estate for the seller.

In a flat fee MLS listing, the listing agreement between the real estate broker and the property owner typically requires the agent to enter the property into the MLS and provide other contracted services, with the agent acting as a "limited service agent". In a flat fee MLS service, the property owner pays the broker a flat fee for the listing services provided. The net effect is to reduce the cost of selling real estate for individual property owners by a) waiving the standard "fiduciary responsibilities" of the listing agent; b) making the real estate industry's MLS available as a marketing tool for property owners desirous of saving money by not paying for all of the typical "full services" of an agent; and c) in essence shifting much if not all of the responsibility for selling the property from the listing agent to the property owner.

Currently there are numerous descriptions used to describe reduced fee and discounted real estate services, some of which are not based on providing limited services at a lower cost like the "flat fee" option. For instance, some full service agents list properties under a full service agreement and charge a flat rate fee that is not a percentage of the sales price. This full service option is in fact a "discounted" full service listing and is different from the Flat Fee MLS service which is the subject of this discussion. This alternative full service listing where compensation to the listing agent is not based on a percentage of the selling price but instead is a fixed dollar amount is sometimes referred to as a "flat rate" listing, and can lead to consumer confusion. Until the industry evolves and adopts a standard practice of terminology, some consumers will continue to be easily confused and should therefore thoroughly understand the services and manner of compensation for those services being considered.

The flat fee MLS service is radically different from traditional real estate brokerage services. Because every State requires a listing agreement between a real estate agent and property owner, the rapid explosion of flat fee service providers has created a gap in the States developing laws governing flat fee services provided by real estate agents. In most real estate board / MLS systems, there are generally two types of listing agreements, although some Boards allow others. The first and most common is called an "Exclusive Right to Sell" listing, in which the seller will not only pay a commission if their property is sold through their listing broker or another MLS broker (buyers agent), but also if the seller finds their own buyer. In an "Exclusive Right to Sell" listing, the listing agent gets the commission specified in the listing agreement regardless of who actually finds the buyer. The second type of listing agreement is called an "Exclusive Agency" listing agreement. This "Exclusive Agency" is one form of agreement that can be used to allow the seller to market their property "By Owner" and pay zero commission if they are successful in finding their own buyer. It is this "Exclusive Agency" listing agreement that forms the basis for many flat fee service provider's listing agreements. In essence, Flat Fee MLS listings are a logical progression of reduced-cost selling alternatives to property owners who are comfortable with managing part or all of the selling process, who believe the MLS will effectively "advertise" their property, and who are willing to pay a buyer's agent a commission.

Listing fees for "flat fee MLS" services cover a wide range, but generally include two components: the flat fee paid to the listing agent, and the commission the property owner agrees to pay a Buyer's Agent (if there is one). The commission which is normally paid to the "listing" broker is replaced by payment of the flat fee.
